These terms apply when you use coldgoat.com (the “site”). The site is operated by ColdGoat (“we”, “us”). By using the site, or by submitting a brief, you agree to these terms and to our privacy policy.
What we do
ColdGoat helps New Zealand food and beverage brands find a contract manufacturer. You submit a brief, we match it against our directory, call manufacturers that look like a fit, and come back to you with a shortlist. We are independent and do not manufacture anything ourselves.
We are not a party to any agreement you reach with a manufacturer. Pricing, terms, quality, and delivery are between you and them.
Submitting a brief
You promise that the information you submit is accurate and that you have the right to share it. You also promise not to use the site to submit anything misleading, unlawful, or that infringes anyone else’s rights.
You retain ownership of your brief. By submitting it you give us the right to use it for the purposes described in our privacy policy: matching, talking to manufacturers about the work, and getting back to you.
Using the site
You agree not to:
- Use the site in a way that interferes with how it works for others
- Try to access parts of the site you are not meant to access
- Scrape, copy, or redistribute content from the site for a competing service
Our content
The site, including its text, design, layout, and graphics, is owned by us or our licensors. You may view it for your own use. You may not copy it for commercial use without our written permission.
No guarantees about outcomes
We do our best to match you with manufacturers that can make your product. We cannot guarantee that a manufacturer will take the job, that pricing will be what you expect, or that the work will go ahead. The shortlist is information, not advice.
The site is provided on an “as is” basis. To the extent allowed by law, we are not liable for any loss arising from your use of the site or from any dealings you have with a manufacturer.
Where you are using the site in trade, both parties agree that the Consumer Guarantees Act 1993 does not apply, to the extent it can be contracted out of under that Act. Nothing in these terms limits any rights you have under the Fair Trading Act 1986 that cannot be excluded.
Privacy
How we handle personal information is set out in our privacy policy.
Changes
We may update these terms from time to time. The last updated date at the top of the page tells you when. By continuing to use the site after a change, you agree to the updated terms.
Governing law
These terms are governed by the laws of New Zealand. The New Zealand courts have non-exclusive jurisdiction over any disputes.
